LEGAL NOTICE:

Please review the following terms and conditions that govern your use of the Up There online store. Please note that your use of our site constitutes your agreement to follow and be bound by these terms. Since we may revise these terms at any time, you should visit this page often to review the terms of use.

All product photography is taken in-house, by employees of Up There and we make every effort to represent as accurately as possible the colours, styles and fits of our products. Please note, the particular technical specifications and settings of your computer and its display could affect the accuracy of its display of the colours of products shown on our site.

Unless otherwise noted, all materials, including images, photographs and written and other materials that are part of this site (collectively, the “Contents”) are copyrights and/or other intellectual property owned, controlled or licensed by Up There. The site as a whole is protected by copyright and all worldwide rights, titles and interests in and to which are owned by Up There.

REFUNDS & EXCHANGES:

Please choose carefully as we do not refund for an incorrect purchase. You are able to exchange an unwanted item for another item in the store, or for an online credit (Gift Voucher) which will be issued to the value of your purchase. The Gift Voucher is valid for 3 Months from the date of issue. Please note; all exchanges are subject to availability.

The buyer is responsible for the cost of shipping item/s back to Up There for a refund or exchange and the item/s are shipped at the customers own risk. In the case of an exchange, the buyer is also responsible for the cost of shipping of the exchanged item. Any item/s being sent back to Up There for a refund or exchange must be in brand new condition as received.

Full name
*Address
*Contact information (email / Phone)
*Purchase information / order number
*Method of payment
*Amount paid
*Reason for refund / exchange
We will send you details via email on how to send the item/s back for refund or exchange.
A refund will not be issued until the items have been returned to Up There and have been inspected. Items that have been approved to be sent back for a refund must be received within 7 days (Australian customers) or 14 days (International customers) of the approval. Refunds will be credited to the customer via the initial method of payment (eg. Credit Card). Any items not received by Up There within the outlined time frame will not be processed for a refund and will be returned to the customer.

Any manufacturing faults found in items purchased from Up There are to be dealt with between the customer and manufacturer and are not the responsibility of Up There.

DELIVERY POLICY:

Please be aware that all orders placed online with Up There are subject to availability. There may be instances where for unforseen circumstances customer orders cannot be fulfilled, in which case we will contact you immediately. Customer satisfaction is our priority and you can be assured we will do everything to make sure you are happy with your purchase.

Up There does not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
Please note that if an item has been lost in transit, we will not dispatch a replacement item immediately. Replacement items will be dispatched at our discretion in accordance with the Australia Post Insurance Policy Or the TNT Insurance Policy. Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.

Up There reserves the right to cancel any order for any reason, at which time, you will be notified via email. All monies will be refunded in the form of original payment.

LOCAL TAXES:

Please note that local charges (customs duty, sales tax) can occur, depending on your region and local customs duties. These charges are at your own expense. We cannot and will not lower the package's value on the customs declaration in order for you to avoid additional charges.

PAYMENT:

The only methods of payment we accept is Paypal.
All prices on our website are in Australian dollars only.

You can be confident that we are committed to protecting your privacy and that all information collected by Up There will be kept confidential.
Up There will not sell its database of customer details or any part thereof to a third party. Any and all the information collected on this website will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned. We respect the right of users to remain anonymous and will not knowingly disclose user identities unless directed by a court of law.

The personal information we collect from you when you place an order with Up There is strictly used to enhance your online shopping experience and provide you with an elevated level of customer service. This allows us to process and fulfill your order successfully. It also helps us in maintaining your account.

We recommend you set up your own personal online account/profile with Up There to enhance your shopping experience. All of your personal information will be kept confidential and will only be used by Laced to help us provide you with quality service.

AUTHENTICITY:

We guarantee that all products listed and sold by Up There are 100% authentic and have originated from our retail store. We do not sell, nor condone the selling of, counterfeit goods.
